საყიდლის ფასი შეადგენს ____________________.

Before you sign — 5 steps

  1. 1Verify the seller by the cadastre code in sivrce’s cadastre search — the active seller is the document owner, not a relative.
  2. 2Check encumbrances — a mortgage or a reservation lien shows in the Public Registry extract and must be cleared before the main contract.
  3. 3Pay the advance by bank transfer with the property in the payment reference — a bank statement proves the amount and the purpose.
  4. 4Set a realistic deadline for the main contract — registration and the notary take time; an overstretched deadline is a legal ground to walk away.
  5. 5Write the penalty percentage into the contract — a penalty applies only when its rate is agreed in writing.

FAQ

What is the difference between a preliminary and a main contract?

A preliminary agreement is a promise: the parties oblige to sign the main sale contract in the future. Title does not pass — it passes only by a notarial deed and Public Registry registration. The preliminary fixes the price, payment and deadline.

Does the preliminary agreement need a notary?

The parties usually agree on notarization, since the main sale deed requires notarial form. The template includes this clause to prevent disputes over form.

What happens to the advance if the deal falls through?

Without a written penalty clause the general rule applies — the party at fault compensates the proven loss. That is why the penalty % and the return rule must be written down.

Can an under-construction apartment be bought via a preliminary agreement?

Yes — common practice: the preliminary fixes the price and the installment schedule until handover. With a developer, verify the company and the project in sivrce’s new-builds catalog.

How much does the main registration cost?

Georgia’s transfer tax is 0%. The main costs are the Public Registry fee and the notary — compute them fully in the purchase cost calculator.
